I would think in theory that the oil to crank distance is intended to be the 
same regardless of capacity.  So, if the pan is truly larger the extra 
capacity is either below (deeper pan) or to the side (wider pan - often at 
bottom with baffles) of the original level.
  The exception would be to reduce oil hitting the crank in extreme driving 
conditions.  But in a situation like that they would probably use a 7 qt. 
pan and only fill it with 5 qt's.  The results in that case would be the 
opposite of what you have.  Has the oil been circulated (filter filled). 
That accounts for some of th capacity.
