Some time in late September, you may recall I mentioned the matter of my old
friend Mick getting taken to task by some headcase with a Triumph 2000 with
a 'clonky' diff? This general issue centred on using litigation to gain a
will because the wear in the diff was so acute that it was really past
redemption. Even so, Mick did what he could to alleviate, even though by his
own admission it wasn't very effective.

Mark Hooper recently sent me this note:
Just cleaning up my overflowing e-mail bin and I reread your note about the
jerk who was berating him over the differential work. Did your friend ever
hear from the fool again?

My reply to Mark was as follows:
Indeed, yes.
Mick actually refunded what he'd charged and on the covering letter wrote
"as a non-prejudical gesture of goodwill." Important legal phrase over here.
Jerk didn't take any notice and still took him to the Small Claims Court
claiming bad workmanship, wasted time, extended travel, stress and a few
other idiotic things.
Outcome was the Judge threw the case out but hit the jerk with GBP250
(US$375) in costs for wasting the court's time and what he claimed amounted
to perjury - half of which proceeds went to Mick. That was 2 weeks ago. We
had a really good time in the pub on part of the proceeds!

Mark suggested I relayed this reply to the list as so many had expressed
interest or had commented on it. What I didn't tell Mark is that the Judge
was "biased." As we were staggering (sorry, walking) back to the
multi-storey from the pub, what should emerge from the gloom of the car park
but a particularly tasteful Jensen Interceptor FF with no less a person than
the Judge himself at the wheel! Clearly a man of taste ... AND we got a wave
and a smile!

One wonders if he belongs to the Jensen list and had posted queries about
"what to do next?" Somehow, i doubt it. The car was very definitely a
superbly cared for original example and probably only a car a Judge could
afford to run it!
