Its like the loitering laws, a tool used selectively to address situations. 
Enforcement goes up after a street race death or two and is nil where there 
is none.  You don't see cops setting up a checkpoint on the outflow of the 
local Sunday church service to check for working tailights, but outside the 
local bar at 2:15 am?
