Is Obama's Health Care Plan headed for a vote at the Supreme Court level?

Something about Kagan having had an earlier interest in the plan (support
for it at some level earlier on) and others saying that as such she should
excuse herself from the vote . . and something similar with Justice Thomas'
wife also having been involved as against the plan, with others saying the
Thomas should excuse himself as well?
