Thanks Jay, I hadn't heard of this one (not that I follow *all* smog-related
legisltation. According to //www.sen.ca.gov/leginfo this was introduced on
September 12 by Senator Jim Costa of Fresno. The bill summary is:
Existing law establishes a motor vehicle inspection and maintenance program
in specified areas of the state. The enhanced program is established for
each urbanized area of the state, any part of which is classified by the
Environmental Protection Agency as a serious, severe, or extreme nonattainment
area for ozone or a moderate or serious nonattainment area for carbon
monoxide
with a design value greater than 12.7 ppm, and in other areas of the
state as specified. Any violation of various requirements relating to the
enhanced program is a misdemeanor. Existing law requires the State Air
Resources Board to assess the relative contribution of upwind emissions to
downwind ozone ambient air pollutant levels and to determine if the
contribution is overwhelming, significant, inconsequential, or some
combination
thereof. This bill would also establish the enhanced program in any
district of origin of upwind emissions, any part of which is classified
by the Environmental Protection Agency as a moderate nonattainment area for
ozone and which has been determined by the state board to make an
overwhelming or
significant contribution to downwind ozone ambient air pollutant
levels in a district that is not in attainment.

I suspect your conclusion is accurate, although I'm not sure why a Fresno
Senator would much care. Perhaps it's because of one of the subcommittees
that he's on.
