Perhaps I am missing something in the discussion of problems with the
insurance company. As I read the post, the damage was caused by your
neighbor. You are not at fault, you were not in an accident.
It seems to me (if you are willing to accept the risk of an
angry neighbor) that your course of action is simple. Ask your neighbor
to make good on his damage.
Certainly provide him with ammunition to recoup what he has paid you,
but I would recommend that you ask for a check.
