Vehicle emissions inspection: exemption.
DESCRIPTION:
This bill would exempt from the biennial vehicle emissions
inspection (smog check) requirement all vehicles 25 or more
model years old.
ANALYSIS:
Existing law generally requires all motor vehicles powered
by internal combustion engines to undergo a biennial smog
check and obtain a certificate of compliance or
noncompliance as a condition of registration. In some
areas of the state, an inspection and certificate of
compliance are required only upon the sale and transfer of
ownership of a vehicle.
The law exempts certain vehicles from the smog check
requirements, including vehicles manufactured prior to the
1966 model year, vehicles which the Department of Consumer
Affairs determines would present prohibitive inspection or
repair problems, and motorcycles and diesel-powered
vehicles until inspection of the latter is technologically
and economically feasible.
This bill would exempt from the smog check requirements all
vehicles 25 or more model years old.
COMMENTS:
1. The intent of this bill is to acknowledge the
relatively minimal impact of 25-years and older vehicles on
vehicle emissions and air quality. Such vehicles
constitute a small portion of the vehicle fleet and many
are considered oclassic carso by their owners and others.
They generally are well-maintained and infrequently
operated. Other older vehicles not considered classic also
are relatively few in number and are driven fewer miles
than the average for vehicles in the state.
2. A large number of owners of classic and elderly
vehicles consider the smog check requirement excessive in
view of the vehicleso numbers and operating
characteristics. Owners also argue that original and
certified emissions equipment and parts are hard or
impossible to obtain, making compliance with the smog check
requirement increasingly difficult or economically
infeasible.
