FOT,

Dale - Thank you for the insights below. They are helpful.

It is sad to hear of the cancellations. Good for VARA making it possible to allow people a choice. Those that feel comfortable going to track can go, and those who do not can choose not to go. Sounds American to me.

We own a business that has been damaged by many of the decisions that that the government has made.

The two previously stated reason for registrations being down in this thread: Financial and Fear of COVID.

There are more reasons fo it, than just those two.

We have a 3rd reason for not registering: The policies and procedures that are having to be put in place for an event to happen.

We have a lot of respect for the race organizers at SVRA, VSCDA, Midwest Council and a few others. They are dealing with a lot to make events a possibility.

However, we feel that the insurance companies, the government agencies and others are really over reaching with some of the policies that they are recommending or forcing on business owners. Therefore, we are not entering events until all of this settles down. We value our time at the track very highly. We enjoy the track time and we especially the time with people whose company we really enjoy. We feel that the polices that are in place will detract greatly from both of those things happening.

Again, we do not fault the organizations for what they are doing. We just will not participate based on some of the procedures and polices being put in place.

Hopefully, there are brighter times ahead for those of who enjoy motorsports. Kind of like the golfers that we see out on courses when we drive-by courses in the area (BTW-We do not play golf). Seems like Covid does not exist for those who play golf, it is business as usual for them.

Look forward to seeing people at the track in the future.

Paul Ricco

It is a drafting trick. Waivers usually cannot a apply to reckless or intentional misconduct (and in some states cannot apply to “gross negligence”). Moreover, the waiver in section 1 gives an immediate defense to all defendants (“releasees”) on the basis that the signer “fe[lt] unsafe” (whatever that means) at some time before any injury and still participated [or did not give notice]. This is a trial lawyer’s delight and, at minimum, will cause defense counsel to delay settlement until the edge of trial, running up litigation expenses, until every statement of the plaintiff pre-injury has been collected and parsed. If you sign this, do not talk to anybody (even in jest) about race or track conditions till your car is on the trailer and off the premises. Other language gives a defense based on your non-disclosure of any virus symptoms; if you cough or have nausea (probably nerves and a crummy hot dog) you had better tell race organizers and they will have no choice but to escort you out.
