John,

This is VERY good advice.  I'd say your next step is to contact the state 
insurance commission.  These people have a lot of clout, and insurnace 
companies are scared to death of them.

A friend of mine always seems to have bad luck with insurance companies, so 
he has the state insurance commissioner's number in his Roledex.  If he is 
having a problem with an insurance company, he can call this guy up, and 
it's amazing how fast the communication channels open up! : )

For example,  after he had a pretty nasty accident, he learned about 
umbrella coverage (something EVERYONE should have if they don't).  This 
coverage is basically an insurance policy hidden between your car and home 
insurance, and will kick in when your standard policies don't.  It's also 
very cheap for the coverage you get.  He asked if he could get umbrella 
coverage after this accident, and the company said no, since he just had a 
wreck.  One call to the insurance commissioner had the agent calling back 
within a half hour, asking him why he called the commission, and that they'd 
be more than happy to write him up an umbrella plan. : )

You might even suggest to the insurance companies you are going to contact 
the commission and see what they say.  If you have no luck there, then it's 
probably time to hire a personal injury lawyer and take the other person and 
thier insurance company (and possibly yours) for all they're worth.
