Indiana calls it "conditional release".
You are released under the condition that you don't get caught again in that
County in 6 months and under the condition that you pay the County
Prosecutor a fee, which is a few bucks more that what a real ticket would
cost. The advantage is that there are NO points associated with this and it
is not reported to your insurance. At the 6 month point, it never happened.
The State still gets about $25 of your $125, the County gets another $25,
but the Prosecutor gets $75, which is $50 more than this office would get
for a regular ticket.
There are also City Courts here in Indiana, the fines (cheap! - $50+/-) and
records, never leaving the City, but most of the local law enforcement are
such jerks that they seldom write the citation to this Court. They want to
see points on your licensee. But they are not very smart, usually making
errors on the citation, so a lawyer ($125 to $250) can get the whole thing
thrown out without any fine.
About 6 years ago, coming into town on a side road, the Escort goes off just
before the City Limit sign. I back off to a whopping 37 as I pass the sign
with a 30 limit above it. Coasting as I pass this cop at 29 in this stupid
30 zone. He pulls me over. Says that he got me at 52! But that he will
let me agree to the steady speed reading that his speedgun shown for 47.
Still more that 15 over the limit and 3 points.
I would not agree to this, stating that his equipment was faulty. This guy
turned 4 shades of red when I wouldn't cave to this. Got real upset that I
would question his superior authority. He wrote the citation for 42 (only 2
points), getting my street address and licensee # wrong! My lawyer had no
problem getting this citation changed to a "no registration in vehicle"
charge for all of $125 for his time and a $60 fine for the charge for the
Court, but it did not have any points.
All that the system wants is your MONEY! Public good and safety are far
down the list!
Usually the best way to handle any ticket is to say little, NEVER admitting
to any wrong doing or guilt. Then if you don't have the time to defend your
self, you hire an lawyer. Even at $4-500 the pay back on your insurance
will be less than 2 years!
