Heater Construction

I was wondering if any one could help me with a question on the heater
construction-Recently I've noticed that when I'm driving a long the
Heater admits air onto my feet even when it is turned off. Inspection of
the heater reveals that there is a plate inside it that tilts towards
the back of the heater (the front of the car) when I switch the heater
slide control to off.

However when the heater is off there is still a gap between the edge of
my plate and the back of the heater- and this must be where the air is
coming in. My question is as I have a vague recollection of there being
a spare piece of thin foam rubber floating round the floor of the car
when we stripped it- Should this piece of foam be in the heater and
blocking this gap off-if so what holds it in?
