Baud Rate Q

We finally joined the 20th Century (yes, as it is either over or ending)
and bought a computer at home. We got the iMac with an internal 56K baud
modem. It also came with a free month of Earthlink. My question is that
every time I log on, the baud rate is indicated at 26,400 or 24,600. Never
more. I sent an e-mail to Earthlink asking if they did not have enough 56k
modems. They said all their modems were 56k, that the FCC prohibits 56K,
but I should be coming in at 40K or more. They suggested adding something
like "&F" to my modem initiation string. But that was already there. They
suggested switching to a different modem protocol, which I did, but that
dropped the speed down to 24k.

Anyone have any ideas here? I still do not trust that Earthlink is telling
me the truth about their modems.
