The EPA decides who has to test and to what degree. If the air management
district that you live in fails or continues to fail federal air quality
standards then that area is responsible to get in compliance. Vehicle
testing is just one method. Mass transit usage is another. As the air
pollution increases in this country more air management districts will fail
federal standards.
