I use mine in third,  why not?  I could shift, but all I have to do is flip the 
little lever.   Usually I do it when I know I am going to have to stop in under 
a mile or so for stoplight anyway....

don't know about not engaging until on top of the hll,  Mine has been a bit 
wierd when it gets hot latetly...
