construed to deny or disparage others retained by the people. "
so it's all in the interpretation, because I could say what that means is
that the right of people to smoke shall not deny a bartender the right to a
safe working environment. Treating the constitution as an absolute is
foolish, because every one of the rights guaranteed would infringe on all the
others if carried to its utmost. The rights will always have to be balanced
against each other so it is rare that any argument can be proved by quoting
one quick line of the constitution.
That's why it's hard.
