Don't know how it happens elsewhere, but in Texas most of the racetrack 
complaints are setups by the developers who want to buy the land cheap and 
sell more tract houses. They get "concerned residents" who bought their homes 
cheap because of the location and are willing to screw thousands of fans out 
of their sport in order to up the value of their shacks a few bucks. One 
local track (Green Valley) kept going for some time, despite encroaching 
Dallasites, by finally getting tough and counter-suing for harrassment (or 
however you say that in lawyer-speak). 
If you lose, sell the land to some quiet operation like a lead smelter, 
radioactive material storage facility or a minimum-security prison.
